1. Subject

• Booking-Corner & Swisskischool offers an online booking platform and acts as an agent for organizers of events or courses who wish to sell their services on the said platform to buyers. There is no contractual relationship between the buyer and the agent. The buyer only has a contractual relationship with the organizer.

• By validating his order, the buyer enters into a contract with the organizer for the service notified on the ticket or on the confirmation, and only for that service. The purchaser must contact the organizer directly for any queries or claims relating to the reserved service, unless the query relates exclusively to the reservation of the service.

2. General conditions

• Booking on the Booking-Corner & Swisskischool platform implies acceptance and application of the present general terms and conditions of sale. These terms and conditions apply only to the buyer, agent or organizer.

  The purchaser has also taken note of the organizer's general terms and conditions (safety, instructions, provisions) and agrees to abide by them.

  The purchaser is informed and accepts that Booking-Corner & Swisskischool will collect the amount of the service(s) on his/her behalf and dispose of it in accordance with the collection power of attorney signed with the organizer.

3. Cancellation, modification or postponement of services

• The organizer may reserve the right to modify, postpone or cancel a service. The organizer's general terms and conditions give details of any refunds. By accepting the general terms and conditions, the purchaser declares that he/she waives any right to compensation, legal action or proceedings against the agent.

• If the organizer accepts a refund of the service, the purchaser of the service is entitled to reimbursement of the price in accordance with the organizer's general terms and conditions of sale. In the event of a dispute between the purchaser and the organizer concerning services paid for online only, the agent will act as mediator between the purchaser and the organizer to ensure that the point in the general terms and conditions of sale concerning reimbursement is respected.

4. Exclusion of liability

• The organizer is responsible for the safe and lawful execution of his service.

  The agent accepts no liability, including negligence, for the performance of the service, for any damage to property or personal injury, or for the postponement or cancellation of services.

  The agent accepts no liability for any damage suffered by the purchaser before, during or after the event. The agent rejects all claims for compensation.

  The organizer is solely responsible for the quality and safety of his services.

5. Prices

• The price of the service is visible to the purchaser as soon as the service has been added to the shopping cart, before the collection procedure begins. The price is set by the organizer, who is solely responsible for ensuring that it is correctly displayed on his website.

  Booking-Corner & Swisskischool do not charge fees for services booked on its platform. The organizer may, however, define fees and discounts for services booked on Booking-Corner & Swisskschool, which are also visible when viewing the basket.

6. Shipping conditions

• Once the amount of the reserved service has been paid in full, Booking-Corner & Swisskschool allow the buyer to print out the confirmation.

  The agent does not send any confirmation by post, either in Switzerland or abroad. The agent sends an electronic confirmation in the form of an email to the buyer for each booking. This confirmation includes a unique code enabling the buyer to prove payment of the booked service to the organizer. The responsibility for the validity of the email address lies entirely with the purchaser. No confirmation can be sent if the address is invalid.

  In the case of events, confirmation enables tickets to be reprinted at any time (print@home).

7. Data protection

• The agent undertakes to treat purchasers' personal data with respect and security, and to comply with data protection regulations.

  No data will be passed on for promotional or commercial purposes. The organizer's general terms and conditions define how the buyer's data may be processed by the organizer.

  The agent makes every effort to protect his system and network, but he cannot guarantee absolute protection, nor can he be held liable for unlawful interference or eavesdropping.

8. Final provisions

• The place of performance for the agent's services is Sierre (3960 Sierre, VS, Switzerland).

  The purchaser waives all claims against the agent.

  The agent reserves the right to amend these GTC at any time. Amendments will be posted on the Booking-Corner & Swisskischool website and will come into effect at the time of posting.

  Should one or more provisions of these GTC be or become null and void or unenforceable, in whole or in part, this will not affect the validity of the remaining provisions of these GTC. In such a case, the parties will replace the null and void or unenforceable provision with a valid and enforceable provision that best meets the economic objective pursued by the provision to be replaced. This also applies in the event of a regulatory loophole in these GTC.

  These GTC and any disputes arising out of or in connection with the relationship between the agent and the purchaser of services shall be governed exclusively by Swiss law.
